1. Introduction

These Terms and Conditions ('Agreement') govern the rental and use of shortlet apartments managed under the Itosa Apartment brand in Lagos, Nigeria. By completing a booking — whether directly or through a third-party platform — the guest ('Guest') agrees to be bound by this Agreement. Itosa Apartment reserves the right to update these terms; the version in effect at the time of booking shall apply.

2. Definitions

'Guest'Any individual or group who books and/or occupies an Itosa apartment.
'Reservation'A confirmed booking of an apartment unit for a specified period.
'Check-in Date'The date and time from which the Guest is entitled to occupy the apartment.
'Checkout Date'The date and time by which the Guest must vacate the apartment.
'Caution Deposit'A refundable security deposit collected to cover potential damages.

3. Properties

3.1 Surulere Location

  • Unit type: 1-Bedroom Apartment
  • Location: Surulere, Lagos State, Nigeria
  • Maximum occupancy: 2 adults (additional guests by prior arrangement)
  • Amenities include: air conditioning, Wi-Fi, kitchen, bathroom, TV, water heater

3.2 Isheri Location

  • Unit types: 2-Bedroom and 3-Bedroom Apartments
  • Location: Isheri, Lagos State, Nigeria
  • Maximum occupancy: 4 adults (2-Bed) / 6 adults (3-Bed)
  • Amenities include: air conditioning, Wi-Fi, fully equipped kitchen, multiple bathrooms, TV, washing machine, generator backup

4. Booking & Reservation

4.1 Booking Confirmation

A reservation is only confirmed upon receipt of full payment or an agreed deposit, and a written booking confirmation issued by Itosa Apartment management. Verbal or informal agreements do not constitute a confirmed booking.

4.2 Minimum Stay

  • Minimum stay: 1 night for nightly bookings.
  • Weekly and monthly rates require a minimum of 7 and 28 nights respectively.

4.3 Rates & Pricing

Rates are quoted in Nigerian Naira (NGN) and may vary by season, duration, and booking channel. Published rates are subject to change without notice; however, the rate confirmed at booking is guaranteed for the reserved period.

5. Payment Terms

  • 100% of the booking amount is due at the time of reservation unless a deposit arrangement is expressly agreed in writing.
  • Accepted payment methods: bank transfer (Nigerian accounts), POS, and designated mobile payment platforms.
  • International card payments attract a processing surcharge of 1.5–3.5% (card network dependent).
  • Payment receipts will be issued for all transactions.
  • Partial payment arrangements must be fully cleared no later than 48 hours before check-in.

  • Early check-in and late checkout are subject to availability and must be pre-arranged.
  • A late checkout fee equivalent to 50% of the nightly rate applies for checkout between 11:00 AM and 2:00 PM.
  • Checkout after 2:00 PM will be charged a full additional night unless otherwise agreed.

7. Guest Conduct & House Rules

7.1 General Conduct

  • Guests must conduct themselves in a respectful manner at all times.
  • Noise levels must be kept to a minimum, especially between 10:00 PM and 7:00 AM.
  • Itosa Apartment operates a strict no-party, no-event policy. Violations will result in immediate eviction without refund.
  • The Guest is responsible for the conduct and safety of all persons accompanying them.

7.2 Smoking & Substances

  • Smoking is strictly prohibited inside all apartment units. A deep-cleaning fee of ₦15,000 will be charged for violations.
  • The use of illegal substances on the premises is strictly prohibited and will result in immediate eviction and may be reported to the appropriate authorities.

7.3 Pets

  • Pets are not permitted in any Itosa Apartment unit unless prior written approval is obtained.
  • Unauthorised pets may result in forfeiture of the caution deposit and additional cleaning fees.

7.4 Visitors

  • Overnight visitors who are not registered guests are not permitted without prior management approval.
  • Day visitors must not exceed the maximum occupancy of the unit.

7.5 Property Use

  • The apartment is for residential use only. Commercial activities, filming (without consent), or sub-letting are prohibited.
  • Guests must not tamper with fixtures, electrical systems, or internet equipment.
  • Guests are responsible for proper disposal of waste as directed by management.

8. Maintenance & Repairs

Itosa Apartment will endeavour to maintain all properties in good working order. Guests should report maintenance issues promptly to management. Guests must not attempt to carry out their own repairs. Emergency contacts for maintenance will be provided at check-in.

9. Liability

9.1 Guest's Belongings

Itosa Apartment accepts no liability for loss, theft, or damage to the Guest's personal belongings during their stay. Guests are advised to keep valuables secured and obtain travel or personal property insurance where possible.

9.2 Personal Injury

Itosa Apartment shall not be held liable for any personal injury sustained on the premises, except where directly caused by the gross negligence of management. Guests use the premises and all facilities at their own risk.

9.3 Third-Party Services

Where management facilitates or recommends third-party services (transport, laundry, food delivery), Itosa Apartment accepts no liability for the quality, safety, or performance of those services.

10. Damage & Breakages

The Guest accepts full financial responsibility for any damage to the apartment, fixtures, fittings, or equipment caused during their stay, whether by the Guest or any accompanying person. Damage discovered at checkout will be assessed and deducted from the caution deposit. Where damages exceed the deposit, the Guest will be invoiced for the shortfall, payable within 7 days.

11. Privacy & Data

Personal information collected during the booking process (name, contact details, identification) is used solely for reservation management and regulatory compliance. Itosa Apartment will not sell or share Guest data with third parties except as required by Nigerian law.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Lagos State.

13. Amendments

Itosa Apartment reserves the right to amend these Terms and Conditions at any time. Updated versions will be published and made available to guests prior to booking. Continued use of the service after an update constitutes acceptance of the revised terms.

14. Agreement Acknowledgement

By completing a booking with Itosa Apartment, the Guest confirms that they have read, understood, and agree to abide by these Terms and Conditions, the Cancellation Policy, and the Refund Policy in their entirety.
